    Notice of Public Hearing

    Under IC 4-22-2-24, notice is hereby given that on July 21, 2016, at 9:00 a.m., at the Indiana State Library, 315 West Ohio Street, History Reference Room 211, Indianapolis, Indiana, the Department of Child Services will hold a public hearing on a proposed rule amending 465 IAC 2-14 to correct references to collaborative care for older youth and related department procedures. A new rule is proposed to be added at 465 IAC 2-15.1, concerning older youth in the collaborative care program, including establishment of eligibility requirements, conditions for consideration of an application for entry into the collaborative care program, procedures for determination of eligibility and filing of a petition in the appropriate court for receipt of older youth services through the program, conditions for housing and services to be provided to current or former foster youth, to provide for payments for housing or services to be made to or on behalf of youth approved by the court for collaborative care, to authorize the Department of Child Services to establish guidelines for the eligible youth's continuing participation in the program, to specify the terms of agreements between the Department of Child Services and the youth, and continuing eligibility of youth receiving collaborative care services. The rule specifies the grounds and procedures for terminating voluntary collaborative care agreements and services. The rule amends 465 IAC 3-3, concerning administrative hearings, to provide a procedure for administrative review by the Department of Child Services of certain determinations under the collaborative care program. The rule repeals 465 IAC 2-15.
    Pursuant to IC 4-22-2-24(d)(3), the Department of Child Services has determined that changes to the current rules are necessary to comply with changes to federal and state law and to delete provisions that were rendered obsolete or unnecessary by changes in federal and state law. The proposed rule will not impose any new or increased costs on any regulated entity.
    All parties interested in the proposed rule are invited to attend the public hearing and to offer public comments. In lieu of attendance at the public hearing, written comments may be sent to: DCS, Attention John Wood, 402 W. Washington St., Room E306, Indianapolis, IN 46204. Correspondence should be identified in the following manner: "COMMENT RE: LSA Document #16-55, Collaborative Care Rules". Written comments may also be submitted via e-mail to DCSpubliccomments@dcs.in.gov. All written comments concerning the rule received by the Department of Child Services will be available for public inspection at the Department of Child Services Office of General Counsel, Indiana Government Center South, 402 West Washington Street, Room E306, Indianapolis, Indiana.
