Notice of Public Hearing

Under IC 4-22-2-24, notice is hereby given that on July 21, 2016, at 1:00 p.m., at the Indiana State Library, 315 West Ohio Street, History Reference Room 211, Indianapolis, Indiana, the Department of Child Services will hold a public hearing on a proposed rule amending 465 IAC 1-1 to delete obsolete references, to define the "department" as the "Indiana department of child services", and to replace "division of family and children" with the "department" or "central collection unit" as appropriate throughout the rule. The proposed rule amends 465 IAC 1-1-1 to include "nonpublic assistance recipient" and to make other technical changes. The proposed rule amends 465 IAC 1-1-2 regarding child support services fees paid by persons who have not received federal public assistance, and amends 465 IAC 1-1-11 regarding recoupment of overpayments of child support. The proposed rule repeals 465 IAC 1-1-4, 465 IAC 1-1-7, 465 IAC 1-1-9, and 465 IAC 1-1-10.

Pursuant to IC 4-22-2-24(d)(3), the Department of Child Services has determined that changes to the current rules are necessary to reflect changes in the name of the agency responsible for operation of the child support program in Indiana under Title IV-D of the U.S. Social Security Act and to delete provisions that were rendered obsolete or unnecessary by changes in state or federal law. The proposed rule will not impose any new or increased costs on any regulated entity.

All parties interested in the proposed rule are invited to attend the public hearing and to offer public comments. In lieu of attendance at the public hearing, written comments may be sent to: DCS, Attention John Wood, 402 W. Washington St., Room E306, MS47, Indianapolis, IN 46204. Correspondence should be identified in the following manner: "COMMENT RE: LSA Document #16-54, Child Support Rules". Written comments may also be submitted via e-mail to [e-mail]. All written comments concerning the rule received by the Department of Child Services will be available for public inspection at the Department of Child Services Office of General Counsel, Indiana Government Center South, 402 West Washington Street, Room E306, Indianapolis, Indiana.
