Notice of Public Hearing

Under IC 4-22-2-24, notice is hereby given that on July 20, 2016, at 9:00 a.m., at the Indiana Government Center South, 402 West Washington Street, Conference Center Room 5, Indianapolis, Indiana, the Office of the Secretary of Family and Social Services – Office of Medicaid Policy and Planning will hold a public hearing on a proposed rule amending 405 IAC 5-14 to make changes pertaining to the monetary limitation on dental services and the minimum age for topical application of fluoride and to update the verbiage and terminology of covered dental services.

Pursuant to IC 4-22-2-24(d)(3), the Indiana Family and Social Services Administration's (FSSA) – Office of Medicaid Policy and Planning (OMPP) has determined that these changes are necessary in order to reflect the ruling on dental services in Bontrager v. FSSA, 697 F.3d 604 (7th Cir. 2012), which effectively removed the $1,000 cap on dental services. Additionally, the fluoride varnish changes are necessary in recognition of current dental practices. Terminology updates are also needed in order to allow for easier interpretation of Medicaid rules for all parties. FSSA-OMPP's proposed rule will not impose any new compliance costs on any regulated entity.

All parties interested in the proposed rule are invited to attend the public hearing and to offer public comments. In lieu of attendance at the public hearing, written comments may be sent to: FSSA, Attention: Amber Swartzell c/o Michael Cook, 402 W. Washington St., Room W451, Indianapolis, IN 46204. Correspondence should be identified in the following manner: "COMMENT RE: LSA Document #15-450, Dental Covered Services Rule". All written comments concerning the rule received by the FSSA - OMPP will be available for public inspection at FSSA's Office of General Counsel, Indiana Government Center South, 402 West Washington Street, Room W451, Indianapolis, Indiana.
