    DIGEST

    Temporarily amends 326 IAC 7-3-1 to revise the applicability for ambient sulfur dioxide monitoring and 326 IAC 7-3-2 to add provisions for continuing monitoring and responsibility for existing monitors. Statutory authority: IC 13-14-8-1. Effective May 12, 2016.


    SECTION 1. (a) This SECTION supplements 326 IAC 7-3-1.

    (b) Sulfur dioxide ambient monitoring requirements in 326 IAC 7-3 apply to a source:
    (1) located in an area that is classified as nonattainment for the one (1) hour national ambient air quality standard for sulfur dioxide; and
    (2) that operates an ambient monitor and meteorological instrumentation system in accordance with an approved monitoring plan described in 326 IAC 7-3-2.

    SECTION 2. (a) This SECTION supplements 326 IAC 7-3-2.

    (b) A source subject to 326 IAC 7-3 that operates an ambient monitor and meteorological instrumentation system in accordance with 326 IAC 7-3 must continue to operate the ambient monitor and meteorological instrumentation system unless the source receives approval of a waiver from the commissioner under 326 IAC 7-3-2(d).

    (c) A source that contributed greater than fifty percent (50%) of the culpable emissions of sulfur dioxide, as determined through dispersion modeling, to concentrations measured at the time of the nonattainment designation for the one (1) hour national ambient air quality standard for sulfur dioxide, must operate any existing monitors to which it contributed emissions unless the source receives approval of a waiver from the commissioner under 326 IAC 7-3-2(d).

    SECTION 3. A variance request from the requirements of this document shall be made in accordance with IC 13-14-8-8.
