TITLE 312 NATURAL RESOURCES COMMISSION

DIGEST

Temporarily amends 312 IAC 11-5-2 by extending from January 1, 2010, to November 1, 2010, the date by which a person may seek from the Department of Natural Resources the status of a lawful nonconforming use for a pier that is longer than 150 feet on a public freshwater lake (or longer than 300 feet on Bass Lake, Starke County). Effective February 1, 2010.

SECTION 1. This document assists in implementation of IC 14-26-2 and temporarily amends 312 IAC 11-5-2.

SECTION 2. The definitions contained in IC 14-8-2, IC 14-26-2, 312 IAC 1, and 312 IAC 11-2 apply throughout this document.

SECTION 3. The date by which a person must deliver to the department a written request and supporting documentation, sufficient to demonstrate the existence of a lawful nonconforming use that is governed by 312 IAC 11-5-2(b)(5), is extended from January 1, 2010, to November 1, 2010.
