Section 646IAC5-10-9. Request for appeal to the review board

Within fifteen (15) days after the mailing date of an administrative law judge decision, the adversely affected party may appeal the decision to the review board. The appeal shall be filed pursuant to the instructions set forth on the face of the administrative law judge decision. The review board may, in its discretion:

(1) hold a hearing on the matter appealed; or

(2) review the record from the administrative law judge hearing and issue their decision based upon that review.
