Section 460IAC2-4-29. Informal administrative review

(a) A licensed manager may file a written grievance with the director of blind and visually impaired services within fifteen (15) business days of notification of the agency action complained of. The director or director's designee must hold an informal conference with the licensed manager within:
(1) fifteen (15) business days of the receipt of the request; or
(2) such other period of time agreed to by the licensed manager and the director.
(b) Transportation, reader, or other communication services, if needed and requested, must be arranged for the licensed manager by the state licensing agency.
(c) The director of blind and visually impaired services, or the director's designee, shall file a written decision from the informal conference on the licensed manager within ten (10) business days of the conference.
(d) If the licensed manager disagrees with the written decision from the informal conference with the director of blind and visually impaired services, or the director's designee, the licensed manager may request a full evidentiary hearing. The request must be:
(1) made in writing; and
(2) filed with the director of DDRS within fifteen (15) days after service of the blind and visually impaired services director's decision in subsection (c).
