Section 312IAC11-4-6. Boatwell fills

  •    (a) A written license under IC 14-26-2 and this rule is required to fill an existing boatwell along a public freshwater lake.

      (b) To qualify for a license, the existing boatwell must:

    (1) not exceed twenty (20) feet wide;

    (2) not extend more than thirty (30) feet landward from the shoreline or water line;

    (3) not be filled until a seawall or other permanent barrier has been constructed across the lakeward end of the boatwell to prevent the fill material from entering the public freshwater lake; and

    (4) be filled with only clean, nontoxic material.

      (c) Erosion from disturbed areas landward of the shoreline or water line must be controlled to prevent its transport into the lake.
