    FOR: RELIEF TO VICTIMS OF STATE FAIR ACCIDENT


    TO ALL TO WHOM THESE PRESENTS MAY COME, GREETINGS;

    WHEREAS, pursuant to Ind. Code § 15-13-7 and Ind. Code § 15-3-3-3, the Indiana State Fair Board and Indiana State Fair Commission (hereinafter "Commission") are responsible for holding an annual state agricultural fair (hereinafter "Indiana State Fair"); and

    WHEREAS, during the 2011 Indiana State Fair on August 13, 2011, an accident occurred which resulted in death and physical injuries; and

    WHEREAS, on August 15, 2011, the Central Indiana Community Foundation (hereinafter "CICF"), in consultation with the Commission, created the Indiana State Fair Remembrance Fund (hereinafter "Remembrance Fund") to assist the families of individuals who perished and physically injured individuals and their families; and

    WHEREAS, many individuals and organizations have made generous charitable donations to the Remembrance Fund, and it is the goal of the Commission to distribute Remembrance Fund monies to victims and their families in accordance with protocols to be developed to determine eligibility and the calculation of gift amounts.

    NOW, THEREFORE, I Mitchell E. Daniels, Jr., by virtue of the authority vested in me as Governor of the State of Indiana, do hereby order that:

    1. The state shall accept a grant from CICF of the charitable donations that have been contributed to the Remembrance Fund. The state will deposit the entire proceeds of the Remembrance Fund, together with any other private contributions, into a restricted fund called the State Fair Relief Fund ("Relief Fund"). The sole purpose of the Relief Fund shall be to receive and distribute charitable donations to assist the victims of the state fair accident (the "Award Recipients"). The Relief Fund shall consist solely of philanthropic contributions; no general fund dollars shall be deposited into the Relief Fund.

    2. The Commission shall provide oversight of the Relief Fund.

    3. The protocols developed will be used to determine eligibility for gift payments and the appropriate calculation of such payments.

    4. The Relief Fund shall consist solely of charitable donations made by individuals and entities out of a detached and disinterested generosity to assist the Award Recipients. All payments from the Relief Fund are voluntary and shall represent a gift of charitable proceeds.

    5. Payments from the Relief Fund are not intended as compensation for or in exchange for the waiver of any legal rights arising under the events of August 13, 2011.

    6. This Executive Order shall expire upon payment of all monies contributed to and held in the Relief Fund, or on December 31, 2012, whichever is earlier.
