    Dear Senator Young:

    This letter is to provide the written notification to the Administrative Rules Oversight Committee required under Indiana Code § 4-22-2-19.

    Public Law #2006-27 (2006 HEA 1279), which was signed into law on March 14, 2006, authorized the Indiana Utility Regulatory Commission ("IURC") to execute a number of rulemakings. However, this statute also required the IURC to establish forms and procedures either immediately (such as the Provider of Last Resort provisions under Section 54 of the statute) or within a fairly short timeframe (such as the Video Service Franchise provisions under Section 58 of the statute, which had to be in place prior to July 1, 2006). As a result, the IURC's attention and resources, and those in particular of its Telecommunications Division, were of necessity devoted to accomplishing these more immediate demands, in addition to continuing essential day-to-day operations. Consequently, the rulemakings authorized under P.L. #2006-27 were not initiated within the sixty (60) day period contemplated by I.C. § 4-22-2-19.

    Attached is a chart listing the specific rulemakings authorized by P.L. #2006-27, with their respective Indiana Code citations, time deadlines, current status, and expected effective dates, as well as additional relevant information. Please be assured that the IURC is proceeding, and will continue to proceed, in such a manner as to comply with the statutory deadlines and requirements of P.L. #2006-27, as well as to encourage input both from the affected industries and the public, in order to best serve the State of Indiana and its citizens.
