On behalf of the Indiana Department of Child Services (DCS), I am submitting this notice to the Publisher of the Indiana Register and Indiana Administrative Code in compliance with IC 4-22-2-25, which requires that a notice be sent to the Publisher if a rule will not be approved or deemed approved by the Governor within one year of publication of the Notice of Intent to Adopt a Rule. This notice is submitted to the Publisher before the two hundred fiftieth day following the publication of the Notice of Intent to Adopt a Rule.

The Notice of Intent to Adopt a Rule was published in the Indiana Register on February 10, 2016 (DIN: 20160210-IR-465160054NIA).

The rule was adopted by the Indiana Department of Child Services on September 1, 2016, and was submitted to the Indiana Attorney General's office for review as to form and legality on September 2, 2016. The Attorney General has until October 17, 2016, to review the rule. October 17, 2016, is also the two hundred fiftieth day following the publication of the Notice of Intent to Adopt a Rule. Because of the possibility that DCS will not know whether the rule has been approved by the Attorney General until the two hundred fiftieth day from publication of the Notice of Intent to Adopt a Rule, and because review by the Attorney General may necessitate a recall of the rule or other action that would delay submission of the rule to the Governor for approval, DCS anticipates that it may not be possible to complete the rulemaking process by February 10, 2017. Approval or deemed approval by the Governor is expected not later than August 10, 2017.

This notice is being submitted in a timely manner. September 22, 2016, is the two hundred twenty-fifth day after publication of the Notice of Intent to Adopt a Rule.
