60 Day Requirement (IC 4-22-2-19) LSA Document #13-399

On behalf of the Indiana State Board of Education (SBOE), I am submitting this notice in compliance with IC 4-22-2-19, which requires an agency to begin the rulemaking process not later than 60 days after the effective date of the statute that authorizes the rule.

The statutory authority for rulemaking that allows the SBOE to add 511 IAC 10.1, 511 IAC 13, 511 IAC 14, 511 IAC 15, 511 IAC 16, 511 IAC 17, 511 IAC 18, and 511 IAC 19 is found in IC 20-28-2-6.

The SBOE was unable to initiate the rulemaking process within 60 days of the statute authorizing the rule because of extended deliberations regarding the language of the rule and a re-initiation of the rulemaking process.

The SBOE initiated the rulemaking process for LSA Document #13-399 by having its Notice of Intent to Adopt a Rule published in the Indiana Register on August 21, 2013 (DIN: 20130821-IR-511130399NIA).
