IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses

The proposed rule will not impose requirements or costs on small businesses under IC 4-22-2.1-5. The proposed rule requires that licensed pesticide applicators notify the state chemist in writing prior to making the initial preconstruction termiticide application to a structure. However, there are very few termiticide application businesses that are actively engaged in preconstruction treatments, and those businesses average less than one new preconstruction treatment per week. In addition, it is anticipated that most of the written notifications to the state chemist will be in the form of a brief fax, an e-mail message, or website notification. Therefore, the notification burden should be negligible.
