    Temporarily requires deer taken in Franklin County, Fayette County south of State Road 44, and Dearborn County north of State Road 48, to be reported within 12 hours of taking the deer. Requires deer taken in Dearborn County north of State Road 48 on September 24 and 25, 2016, and from November 5 through November 27, 2016, to be taken to a designated official checking station within 12 hours of taking the deer. Temporarily allows an individual who submits an antlered deer that is at least two years old taken in: (1) Franklin County; (2) Fayette County south of State Road 44; or (3) Dearborn County north of State Road 48; to the department for testing of bovine tuberculosis to receive written authorization to take an additional antlered deer in one of these three areas. Temporarily prohibits the intentional feeding of deer in Franklin County and Fayette County south of State Road 44. Effective September 24, 2016.


    SECTION 1. Notwithstanding 312 IAC 9-3-2(n), an individual who takes a deer in:
    (1) Franklin County;
    (2) Fayette County south of State Road 44; or
    (3) Dearborn County north of State Road 48;
    must cause delivery of the deer carcass to an official checking station for registration in the name of the individual who took the deer or cause the reporting of the take by providing true and accurate information required on the department's electronic harvest reporting system within twelve (12) hours of the taking of the deer and before the deer carcass is removed from Indiana.

    SECTION 2. Notwithstanding 312 IAC 9-3-2(n) and SECTION 1 of this document, an individual who takes a deer in Dearborn County north of State Road 48 on September 24 and 25, 2016, and from November 5, 2016, through November 27, 2016, must cause delivery of the deer carcass to a designated official checking station for registration in the name of the individual who took the deer and disease testing within twelve (12) hours of the taking of the deer and before the deer carcass is removed from Indiana.

    SECTION 3. Notwithstanding 312 IAC 9-3-2(t), an individual who takes one (1) antlered deer that is at least two (2) years old in:
    (1) Franklin County;
    (2) Fayette County south of State Road 44; or
    (3) Dearborn County north of State Road 48;
    and submits the deer carcass to the department or to the department's authorized designee for the testing of bovine tuberculosis within twelve (12) hours of taking the deer and before the deer carcass is removed from Indiana may receive written authorization from the department to take one (1) additional antlered deer that is at least two (2) years old in:
    (1) Franklin County;
    (2) Fayette County south of State Road 44; or
    (3) Dearborn County north of State Road 48.
    An individual may take this additional antlered deer authorized under this SECTION of this document in accordance with 312 IAC 9-3-2, 9-3-3 [312 IAC 9-3-3], and 9-3-4 [312 IAC 9-3-4] only from September 24, 2016, through December 11, 2016, and must submit the deer carcass to the department or to the department's authorized designee for the testing of bovine tuberculosis.

    SECTION 4. (a) This SECTION is supplemental to 312 IAC 9-3-2.

    (b) From September 24, 2016, through September 23, 2017, an individual must not bait (as defined in 312 IAC 9-3-2(u)) or knowingly or intentionally feed or attempt to congregate deer or any other mammal in Franklin County and Fayette County south of State Road 44, including the use of mineral and salt licks. Normal agricultural practices, including the use of food plots, are not prohibited.

    SECTION 5. SECTIONS 1 through 4 of this document take effect September 24, 2016.

    SECTION 6. SECTIONS 1 through 4 of this document expire on September 23, 2017.
