    NOTICE: Under IC 4-22-7-7, this document is required to be published in the Indiana Register and is effective on its date of publication. It shall remain in effect until the date it is superseded or deleted by the publication of a new document in the Indiana Register. The publication of the document will provide the general public with information about the Alcohol and Tobacco Commission's (ATC) official position concerning a specific issue.

It is intended solely as guidance and shall be used in conjunction with applicable rules or laws. It does not replace applicable rules and laws, and, if it conflicts with these rules or laws, the rules or laws shall control.

    SUBJECT: The purpose of this nonrule policy is to clarify the ATC's position regarding Trainer Programs outlined in IC 7.1-3-1.5-4.5.

    SCOPE: Certified trainers may train alcohol servers on the selling, serving, and consumption of alcoholic beverages. IC 7.1-3-1.5-4.8. Certified trainers shall not train individuals who plan to become certified trainers. IC 7.1-3-1.5-4.8.

    POLICY: Pursuant to IC 7.1-3-1.5-4.8, the certified trainers may train alcohol servers on the selling, serving, and consumption of alcoholic beverage servers. Although references to trainer programs still exist in Indiana Code, the legislature deleted the authority for trainer programs in IC 7.1-3-1.5-4.8. The note states "[t]he 2008 amendment deleted the (1) designation; deleted the former (2), which read: individuals who plan to become certified trainers; and made a related change.". To ensure consistency and quality of server programs governed by the ATC, trainer programs are disallowed and shall not be sanctioned by the ATC. Only Master Certified Trainers may train individuals who plan to become certified trainers. 905 IAC 1-12.5-1(d).
