UnderIC 4-22-2-24 , notice is hereby given that on October 9, 2014, at 9:40 a.m., at the Indiana State Board of Animal Health, 1202 East 38th Street, Discovery Hall Suite 100, Indianapolis, Indiana, the Indiana State Board of Animal Health will hold a public hearing on a proposed rule that amends345 IAC 8 governing dairy products inspection. The proposed rule will conform the Board of Animal Health rules to the 2013 Grade A Pasteurized Milk Ordinance (PMO). The proposed rule updates the current incorporation by reference of the 2011 PMO to the 2013 revision. The proposed rule updates the current incorporation by reference of certain Food and Drug Administration (FDA) food standards from April 1, 2012, to April 1, 2014. The proposed rule aligns BOAH dairy rules to changes in the state dairy inspection law made in the 2014 session of the General Assembly, including the rule governing penalties for drug residue violations. The proposed rule amends345 IAC 8 to clarify milk testing standards, remove certain raw milk sediment testing requirements, and make other updates and amendments to the dairy inspection rules.The proposed rule does not impose costs beyond what is expressly required by state and federal law. Therefore, the proposed rule does not impose costs on a regulated entity that would require a justification statement underIC 4-22-2-24 (d)(3).Copies of these rules are now on file at the Indiana State Board of Animal Health, 1202 East 38th Street, Discovery Hall Suite 100 and Legislative Services Agency, Indiana Government Center North, 100 North Senate Avenue, Room N201, Indianapolis, Indiana and are open for public inspection.
