TITLE 876 INDIANA REAL ESTATE COMMISSION

Adds 876 IAC 1-1-25.5 and amends 876 IAC 3-2-11 to make failure to comply with an investigation into potential license law violations subject to discipline by the Commission and to require production of appraisal reports upon request of the Office of the Attorney General. SECTION 1. 876 IAC 1-1-25.5 IS ADDED TO READ AS FOLLOWS:

876 IAC 1-1-25.5 Licensee cooperation with investigation

Authority: IC 25-34.1-2-5

Affected: IC 25-1-7; IC 25-1-11; IC 25-34.1

Sec. 25.5. A licensee who is the subject of an investigation by the office of the attorney general into possible violations of IC 25-34.1, IC 25-1-11, or this title shall cooperate with the investigation. Lack of cooperation may include failure to submit a requested written response to a pending investigation or failure to comply with any lawful demand for information made by the office of the attorney general, including failure to comply with any lawfully issued subpoena.

SECTION 2. 876 IAC 3-2-11 IS AMENDED TO READ AS FOLLOWS:

876 IAC 3-2-11 Investigation of appraisals and file records

Authority: IC 25-34.1-3-8

Affected: IC 25-1-7; IC 25-1-11

Sec. 11. An appraiser shall provide access to all appraisal records and related documents upon request by Indiana professional licensing agency compliance officers or the office of the attorney general for investigative purposes. Indiana professional licensing agency compliance officers and the office of the attorney general shall have the right to inspect, review, and copy these documents.
