    IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
    1. Description of the Rule
    The rule incorporates by reference the January 1, 2010, version of federal regulations containing the National Poultry Improvement Plan, including the avian influenza surveillance program. 9 CFR Part 145 and 9 CFR Part 146. The rule declares the state's policy on cooperation with the United States Department of Agriculture to administer the H5/N7 low pathogenic avian influenza eradication program. 9 CFR Part 56.

    2. Description of Affected Industry
    The United States Department of Agriculture, National Agricultural Statistics Service (USDA NAS) 2007 Census of Agriculture reports that the poultry industry in Indiana is comprised of the following number of farms:

    3. Reporting, Record Keeping, and Other Administrative Costs
    The National Poultry Improvement Plan (NPIP) incorporated by reference in the rule is a voluntary program. Therefore, the proposed changes will only require additional reporting, record keeping, or other administrative costs if a business chooses to participate.

    4. Estimated Total Annual Economic Impact on Small Businesses
    The BOAH does not anticipate increased costs to small businesses as a result of adopting the rule.

    5. Justification for Costs
    The Board of Animal Health is required by state law to cooperate with the Indiana State Poultry Association and the United States Department of Agriculture in administering the National Poultry Improvement Plan (NPIP). IC 15-17-10-15. The rule updates the NPIP standards to the most recent version.

    6. Regulatory Flexibility Analysis
    The Board of Animal Health is required by state law to cooperate with the Indiana State Poultry Association and the United States Department of Agriculture in administering the National Poultry Improvement Plan (NPIP). IC 15-17-10-15. The NPIP is a voluntary program for industry administered by the states. Participants must meet specific requirements to enter and remain in the program. States must administer the program in a manner that is consistent with the national program. The NPIP program requirements for participants and states are prescribed by the United States Department of Agriculture. Therefore, alternative methods were not selected.
