    Under IC 4-22-2-23, the Division of Disability and Rehabilitative Services intends to adopt a rule concerning the following:

    OVERVIEW: Adds 460 IAC 13 as a new article establishing standards for determining objective based allocations for individuals receiving services administrated by the Division of Disability and Rehabilitative Services (DDRS) through the Home and Community Based Services Waiver approved by the Centers for Medicare and Medicaid Services consisting of Rule 1 (purpose), Rule 2 (applicability), Rule 3 (definitions), Rule 4 (determining OBA), Rule 5 (Algo levels), Rule 6 (shared staffing), Rule 7 (behavioral support services), Rule 8 (personal allocation review), and Rule 9 (appeal process). Comments and questions may be addressed to the Small Business Regulatory Coordinator for this rule. Statutory authority: IC 12-8-8-4; IC 12-9-2-3; IC 12-11-1.1-9; IC 12-11-2.1-12.
