Notice of Public Hearing

Under IC 4-22-2-24, notice is hereby given that on September 9, 2010, at 10:00 a.m., at the Indiana Government Center South, 302 West Washington Street, Fifth Floor, West Conference Room, Indianapolis, Indiana, the Office of Attorney General for the State will hold a public hearing on a proposed new rule establishing requirements for the brand family directory under IC 24-3-5.4-14 and for calendar quarter escrow deposits and certifications by tobacco product manufacturers not participating in the Master Settlement Agreement entered into on November 23, 1998, by the state and leading United States tobacco product manufacturers.

This rule is intended to close a calendar gap in the escrow payment system. The current annual payment allows nonparticipating manufacturers to sell into Indiana for up to 15 months before escrow is due. Quarterly payment deposits of escrow due will allow the state to monitor the companies more frequently to ensure they are in compliance with the escrow statute.

Copies of these rules are now on file at the Indiana Government Center South, 302 West Washington Street, Fifth Floor and Legislative Services Agency, Indiana Government Center North, 100 North Senate Avenue, Room N201, Indianapolis, Indiana and are open for public inspection.
