    Temporarily amends 312 IAC 9 to govern noncommercial hunts at Summit Lake State Park. Effective July 27, 2007.


    SECTION 1. (a) Notwithstanding 312 IAC 9-2-11, 312 IAC 8-2, and any other provision governing hunting a wild animal within a state park, individuals qualified under this SECTION may hunt Canada geese at Summit Lake State Park one-half (½) hour before sunrise to sunset on September 6, 11, and 13, 2007. Under 312 IAC 9-4-5, the director shall establish four (4) additional dates between September 15, 2007, and January 18, 2008, to hunt Canada geese at Summit Lake State Park.

    (b) A goose may be lawfully taken under this SECTION only by the use of a firearm that may be lawfully used to hunt geese in Indiana.

    (c) In order to apply for a license under this SECTION, an individual must satisfy all of the following requirements:
    (1) Possess a current Indiana hunting license issued under IC 14-22-12-1(a)(2), IC 14-22-12-1(a)(3), IC 14-22-12-1(a)(6), IC 14-22-12-7(a)(1), IC 14-22-12-7(a)(4), or IC 14-22-12-7(a)(5) to take geese.
    (2) Possess a current Indiana waterfowl stamp privilege issued under IC 14-22-7-4 to take geese.
    (3) Possess a current Harvest Information Program registration number issued under 312 IAC 9-4-2.
    (4) Possess a current and signed federal duck stamp to take geese under 50 CFR 20.
    (5) Be at least eighteen (18) years old by September 6, 2007.

    (d) The department shall determine the participants for the hunt by first selecting individuals who have completed a course of instruction in hunter safety under IC 14-22-35. If more individuals who have completed the course apply for a license than the number of participants authorized under this SECTION, the department shall select the participants by a drawing from those individuals who have completed the course. If fewer than the number of individuals who have completed the course apply for a license, the department shall supplement the participation list with applicants who have not completed the course. If supplementing the participation list with applicants who have not completed the course results in more applications than the number authorized under this SECTION, the department shall select the supplemental participants by a drawing from among those individuals who have not completed the hunter safety course.

    (e) An application for a license to participate in any of the seven (7) dates under this SECTION must be completed on a department form as described in this subsection as follows:
    (1) A department form shall be available on the Internet at www.IndianaOutdoor.in.gov.
    (2) In order to qualify for a license, an individual must satisfy at least one (1) of the following requirements:
    (A) For the dates of September 6, 11, and 13, 2007, complete and submit an application online at www.IndianaOutdoor.in.gov by August 10, 2007. The department shall begin accepting online applications on July 27, 2007, at 12 a.m. EDT.
    (B) For the remaining four (4) dates designated by the director under subsection (a) and 312 IAC 9-4-5, complete and submit an application online at www.IndianaOutdoor.in.gov consistent with an announcement by the department.

    (f) An individual must submit no more than one (1) application, which may include up to three (3) other individual applicants. Up to four (4) individuals may be submitted as a unit so that all or none of the applicants can be selected to participate in the hunt. The submission by an individual of more than one (1) application per period disqualifies the individual (and any other individual submitting as a unit with the individual) from participating in the drawing. For the purposes of this subsection, one (1) period is any of seven (7) dates referenced or described in subsection (a).

    (g) Any drawing required by this SECTION shall be conducted on a random basis. The department shall notify the successful applicants by mail.

    (h) Each individual issued a license under this SECTION shall be randomly assigned to specific management units with designated parking assignments. Each license holder must comply with the requirements set forth in the assignment.

    (i) The form of the license under this SECTION shall be as determined by the department. Each participant in the hunt must possess and display evidence of the license as specified by the department.

    (j) During the hunt, an individual must not take more than the daily bag limit to be federally established between September 15, 2007, and January 18, 2008.

    (k) A participant must check in and out at the main gate of Summit Lake State Park and must possess both:
    (1) A hunter check-in card.
    (2) A valid photo identification.

    (l) An individual who takes a goose must deliver the goose to a check station designated within the state park before the person leaves the state park.

    (m) An individual who participates in a hunt under this document must carry no more than fifteen (15) rounds of approved nontoxic shot. All legal shell lengths are authorized but are restricted to sizes ranging from two's (2's) to triple B's.

    (n) An individual who participates in the hunt must abide by all state and federal laws regarding the hunting of migratory game birds and waterfowl.

    SECTION 2. SECTION 1 of this document expires on January 31, 2008.
