    Dear Senator Young,

    On behalf of the Natural Resources Commission (the "Commission"), I am submitting this notice to the Administrative Rules Oversight Committee in compliance with IC 4-22-2-25. Pursuant to IC 14-10-2-4, the Commission adopts rules, other than emergency rules, for the Department of Natural Resources (the "DNR"). The notice is sought because the DNR has determined that the promulgation of the captioned rule may not be completed within one year after publication of the Notice of Intent to Adopt a Rule.

    On November 16, 2010, the Commission preliminarily adopted rule language to govern dog training grounds for coyotes and foxes. The Commission caused the posting of its Notice of Intent to Adopt a Rule for the captioned document on January 12, 2011 (DIN: 20110112-IR-312110004NIA). Public hearings were conducted as scheduled on May 10 and May 11, 2011, to receive comments regarding the captioned document. In addition, numerous public comments have been received by U.S. mail and by e-mail.

    The DNR has determined that new information and ideas have been raised by citizens and constituent groups. The rule lacks sufficient detail regarding cover and escape. The particular specifics of the land forms and complexity of the confined areas are not defined. The number of dogs and coyotes is not specific to the areas to be permitted.

    In addition, the subject of the captioned document and other related subjects were the attention of legislative actions in 2011. These topics are to be the subject of legislative review in Natural Resources Legislative Summer Study Committee meetings in 2011. During the legislative session of 2012, these topics could be the subject of legislation resulting from those 2011 Summer Study Committee meetings.

    The expected date the rule will be approved or deemed approved by the Governor or withdrawn under IC 4-22-2-41 is December 31, 2012.

    This notice is submitted in a timely manner. September 19, 2011, is the 250th day after publication of the Notice of Intent to Adopt a Rule.
