Emergency Rule LSA Document #10-483(E)

Temporarily adds rules concerning scratch-off game number 149. Repeals LSA Document #09-703(E), posted at 20090916-IR-065090703ERA. Statutory authority: IC 4-30-3-9. Effective July 21, 2010.

SECTION 1. The name of scratch-off game number 149 is "$100,000 COLTS CASH".

SECTION 2. Tickets in scratch-off game number 149 shall sell for five dollars ($5) per ticket.

SECTION 3. (a) Each ticket in scratch-off game number 149 shall contain a total of nineteen (19) play symbols. Four (4) play symbols shall be located in the area labeled "WINNING NUMBERS". Fifteen (15) play symbols shall be located [sic] the area labeled "YOUR NUMBERS".

(b) Each play symbol includes a caption that corresponds with and verifies the play symbol as follows:

(c) If a question arises as to the play symbol, the play symbol caption will be used for final clarification.

SECTION 4. (a) Each ticket in scratch-off game number 149 shall contain a total of fifteen (15) prize symbols located beneath and corresponding with each play symbol found in the area labeled "YOUR NUMBERS".

(b) Each prize symbol includes a caption that corresponds with and verifies the prize symbol as follows:

(c) If a question arises as to a prize symbol, the prize symbol caption will be used for final clarification.

SECTION 5. The retailer validation code verifies instant winners in this game for prizes up to five hundred ninety-nine dollars ($599). The retailer validation code that corresponds with and verifies each of these winners is as follows:

SECTION 6. Neither the retailer validation code, the game/pack/ticket number, the validation number, nor any portion thereof are play symbols or prize symbols and are not usable or playable as such.

SECTION 7. (a) The scratch-off material must be removed from the game play data area on individual tickets in order to determine if a ticket is a prize winner.

(b) If any of the "YOUR NUMBERS" play symbols match either of the "WINNING NUMBERS" play symbols, the ticket holder is entitled to win the prize shown below and corresponding with the matching play symbol.

(c) If the "" (DOUBLE) multiplier symbol is revealed, the ticket holder is entitled to win double the prize shown below and corresponding with that play symbol.

(d) If the "" (WIN ALL) symbol is revealed, the ticket holder is entitled to all fifteen (15) prizes shown in the game play data area.

(e) If the "" (TICKETS) symbol is revealed, the ticket holder is entitled to win a 2010 Colts Season Ticket prize package.

SECTION 8. (a) The approximate number of possible prizes and the estimated odds for each prize level are as follows:

Total value of all prizes*: $8,363,751

Prize payout: 69.70%

Overall odds: 1 in 3.99

Approximate print quantity: 2,400,000 (-3%/+1%)

(b) The estimated retail value of the 2010 Colts Season Ticket prize is three thousand two hundred sixty-seven dollars ($3,267).

(c) The approximate number of prizes and the estimated odds provided in subsection (a) is [sic, are] calculated based on an approximate print quantity. The actual quantity of tickets will vary from the approximate print quantity of tickets within a range of minus three percent (3%) to plus one percent (1%). The actual number of prizes and the odds for each prize amount will vary depending on the actual quantity of tickets.

(d) If the print quantity is changed during production of this game or due to subsequent reorders of the game, the ratio of prizes and total value of all prizes to the print quantity will be proportionately maintained so that the overall odds and prize payout percentage will approximate the values provided in subsection (a).

SECTION 9. The 2010 Colts Season Ticket prizes are for the 2010 season only and cannot be renewed. The 2010 Colts Season Ticket prizes must be claimed by close of business on August 2, 2010, in order to receive 2010 season tickets, otherwise the prize will be converted to cash in the amount of the estimated retail value of the prize as provided in SECTION 8(b) of this document.

SECTION 10. Prizes subject to prior sales. The availability of tickets for sale in a scratch-off game depends on retailer orders for tickets. Not all tickets may be made available for sale prior to game closing and opened packs of tickets may be returned by a retailer to the lottery under 65 IAC 3-4-1(b).

SECTION 11. Prizes other than cash will be converted to cash based on the estimated retail value of the prize for the purpose of meeting the commission's duty to pay an obligation on behalf of the prize winner under IC 4-30-11-11. The cash balance remaining after taxes and payment of all applicable debts, if any, shall be paid to the prize winner.

SECTION 12. Any supplemental prizes offered to players through a second chance drawing of nonwinning tickets are not included in the prize structure of scratch-off game number 149. The award of supplemental prizes is governed by the rules and procedures prepared for those promotional drawings under 65 IAC 4-3-10.

SECTION 13. If the director determines an end date for scratch-off game number 149, under 65 IAC 4-2-3(a) [sic], tickets may remain on sale, even if all prizes of one hundred thousand dollars ($100,000) have been claimed. Scratch-off game number 149 may be closed prior to all prizes being awarded.

SECTION 14. 65 IAC 4-1 through 65 IAC 4-3 apply to scratch-off game number 149, "$100,000 COLTS CASH".

SECTION 15. LSA Document #09-703(E) IS REPEALED.

SECTION 16. This document expires sixty (60) days after the last claim date in scratch-off game 149.
