RE: LSA Documents #10-107 – Proposed Rule Regarding Virtual Charter Schools

    Dear Senator Young:

On behalf of the Indiana Department of Education, I am submitting this notice to the Administrative Rules Oversight Committee in compliance with IC 4-22-2-19, which requires an agency to begin the rulemaking process not later than sixty (60) days after the effective date of the statute that authorizes the rule.

The Virtual Charter rule authorizing statute became effective on July 1, 2009, but due to the innovative integration of technology and education, additional research on the impact of the rule resulted in the rulemaking process beginning more than sixty (60) days after the effective date of the statute. The notice of intent for this rule was published in the Indiana Register on February 17, 2010 (DIN: 20100217-IR-512100107NIA).

Your understanding of these circumstances is greatly appreciated. If you need additional information, please do not hesitate to contact me at 232-0524.

    Sincerely,
    Matt Tusing
