    Notice of Public Hearing

    Under IC 4-22-2-24, notice is hereby given that on August 16, 2016, at 9:00 a.m., at the Indiana Government Center South, 402 West Washington Street, Conference Center Room 2, Indianapolis, Indiana, the Office of the Secretary of Family and Social Services – Division of Mental Health and Addiction (DMHA) will hold a public hearing on a proposed rule adding 440 IAC 10-2-3 to set forth the manner in which the DMHA will determine whether there is a need for a new opioid treatment program in a proposed program location's geographic area.
    Pursuant to IC 4-22-2-24(d)(3), the Indiana Family and Social Services Administration (FSSA) – DMHA has determined that these changes are necessary pursuant to IC 12-23-18-5.5(e). FSSA-DMHA's proposed rule will impose new compliance costs on regulated entities. The amount of new compliance costs is indeterminable at this time; however, the proposed rule does not impose any requirements or costs that are not expressly required by state law.
    All parties interested in the proposed rule are invited to attend the public hearing and to offer public comments. In lieu of attendance at the public hearing, written comments may be sent to: FSSA, Attention: Amber Swartzell c/o Terry Cook, 402 W. Washington St., Room W451, Indianapolis, IN 46204. Correspondence should be identified in the following manner: "COMMENT RE: LSA Document #16-1, Opioid Treatment Program Rule". All written comments concerning the rule received by the FSSA - DMHA will be available for public inspection at FSSA's Office of General Counsel, Indiana Government Center South, 402 West Washington Street, Room W451, Indianapolis, Indiana.
