    DIGEST

    Temporarily amends 312 IAC 9-3-2 by adding new license types that can be used to hunt deer in each season. Temporarily amends 312 IAC 9-3-7 to govern hunting white-tailed deer in a designated county under an extra deer license by identifying counties for herd reduction. Effective September 1, 2011.


    SECTION 1. (a) This SECTION supersedes 312 IAC 9-3-2(e) and governs the activities of an individual youth who is hunting deer during the youth deer season.

    (b) A youth hunter may take a deer during the youth deer season established in 312 IAC 9-3-4(b) only if:
    (1) issued a license to hunt deer with:
    (A) a resident youth consolidated hunting license under IC 14-22-11-10(b) or IC 14-22-12-1(a)(24);
    (B) a nonresident youth deer firearm license under IC 14-22-12-1(a)(29);
    (C) a nonresident youth deer muzzleloader license under IC 14-22-12-1(a)(30);
    (D) a nonresident youth deer archery license under IC 14-22-12-1(a)(31);
    (E) a lifetime comprehensive hunting license under IC 14-22-12-7(a)(4);
    (F) a lifetime comprehensive hunting and fishing license under IC 14-22-12-7(a)(5); or
    (G) an apprentice license of the types identified in clauses (A) through (D) under IC 14-22-12-1.7; or
    (2) hunting deer without a license under IC 14-22-11-1 and 312 IAC 9-2-14.

    SECTION 2. (a) This SECTION supersedes 312 IAC 9-3-2(f) and governs the activities of an individual who is hunting deer with a bow and arrow during the archery season.

    (b) An individual may take a deer with a bow and arrow during the archery season established in 312 IAC 9-3-4(c) only if:
    (1) issued a license to hunt deer by bow and arrows with:
    (A) a resident deer archery license under IC 14-22-11-10(a) or IC 14-22-12-1(a)(14);
    (B) a nonresident deer archery license under IC 14-22-12-1(a)(17);
    (C) a resident youth consolidated hunting license under IC 14-22-11-10(b) or IC 14-22-12-1(a)(24);
    (D) a nonresident youth deer archery license under IC 14-22-12-1(a)(31);
    (E) a lifetime comprehensive hunting license under IC 14-22-12-7(a)(4);
    (F) a lifetime comprehensive hunting and fishing license under IC 14-22-12-7(a)(5); or
    (G) an apprentice license of the types identified in clauses (A) through (D) under IC 14-22-12-1.7; or
    (2) hunting without a license under IC 14-22-11-1 and 312 IAC 9-2-14.

    SECTION 3. (a) This SECTION supersedes 312 IAC 9-3-2(g) and governs the activities of an individual who is hunting deer with a firearm during the firearm season.

    (b) An individual may take a deer with a firearm during the firearms season established in 312 IAC 9-3-4(e) of this rule only if:
    (1) issued a license to hunt deer by firearms with:
    (A) a resident deer firearms license under IC 14-22-11-10(a) or IC 14-22-12-1(a)(12);
    (B) a nonresident deer firearms license under IC 14-22-12-1(a)(15);
    (C) a resident youth consolidated hunting license under IC 14-22-11-10(b) or IC 14-22-12-1(a)(24);
    (D) a nonresident youth deer firearm license under IC 14-22-12-1(a)(29);
    (E) a lifetime comprehensive hunting license under IC 14-22-12-7(a)(4);
    (F) a lifetime comprehensive hunting and fishing license under IC 14-22-12-7(a)(5); or
    (G) an apprentice license of the types identified in clauses (A) through (D) under IC 14-22-12-1.7; or
    (2) hunting deer without a license under IC 14-22-11-1 and 312 IAC 9-2-14.

    SECTION 4. (a) This SECTION supersedes 312 IAC 9-3-2(h) and governs the activities of an individual who is hunting deer with a muzzleloader during the muzzleloader season.

    (b) An individual may take a deer with a muzzleloader during the muzzleloader season established in 312 IAC 9-3-4(f) only if:
    (1) issued a license to hunt deer by a muzzleloader with:
    (A) a resident deer muzzleloader license under IC 14-22-11-10(a) or IC 14-22-12-1(a)(13);
    (B) a nonresident deer muzzleloader license under IC 14-22-12-1(a)(16);
    (C) a resident youth consolidated hunting license under IC 14-22-11-10(b) or IC 14-22-12-1(a)(24);
    (D) a nonresident youth deer muzzleloader license under IC 14-22-12-1(a)(30);
    (E) a lifetime comprehensive hunting license under IC 14-22-12-7(a)(4);
    (F) a lifetime comprehensive hunting and fishing license under IC 14-22-12-7(a)(5); or
    (G) an apprentice license of the types identified in clauses (A) through (D) under IC 14-22-12-1.7; or
    (2) hunting deer without a license under IC 14-22-11-1 and 312 IAC 9-2-14.

    SECTION 5. (a) This SECTION supersedes 312 IAC 9-3-2(i) and governs the activities of an individual who is hunting deer during the urban deer season.

    (b) An individual may take a deer during the urban deer season established in 312 IAC 9-3-4(d) of this rule only if:
    (1) issued a license to hunt deer with:
    (A) a resident deer archery license under IC 14-22-11-10(a) or IC 14-22-12-1(a)(14);
    (B) a nonresident deer archery license under IC 14-22-12-1(a)(17);
    (C) a resident extra deer license under IC 14-22-12-1(a)(18);
    (D) a nonresident extra deer license under IC 14-22-12-1(a)(19);
    (E) a resident youth consolidated hunting license under IC 14-22-11-10(b) or IC 14-22-12-1(a)(24);
    (F) a nonresident youth deer archery license under IC 14-22-12-1(a)(31);
    (G) a nonresident youth deer extra archery license IC 14-22-12-1(a)(32);
    (H) an apprentice license of the types identified in clauses (A) through (G) under IC 14-22-12-1.7;
    (I) a lifetime comprehensive hunting license under IC 14-22-12-7(a)(4); or
    (J) a lifetime comprehensive hunting and fishing license under IC 14-22-12-7(a)(5); or
    (2) hunting deer without a license under IC 14-22-11-1 and 312 IAC 9-2-14.

    SECTION 6. (a) This SECTION supplements 312 IAC 9-3-2(j) and governs hunting deer under an extra deer license in a designated county.

    (b) A person may take an antlerless deer under this SECTION of this document only if:
    (1) issued a license to hunt deer with:
    (A) a resident extra deer bonus antlerless license under IC 14-22-11-10(a) or IC 14-22-12-1(a)(18);
    (B) a nonresident extra deer bonus antlerless license under IC 14-22-12-1(a)(19);
    (C) a resident youth consolidated hunting license under IC 14-22-11-10(b) or IC 14-22-12-1(a)(24);
    (D) a nonresident youth extra deer bonus antlerless license under IC 14-22-12-1(a)(32);
    (E) an apprentice license of the types identified in clauses (A) through (D) under IC 14-22-12-1.7;
    (F) a lifetime comprehensive hunting license under IC 14-22-12-7(a)(4); or
    (G) a lifetime comprehensive hunting and fishing license under IC 14-22-12-7(a)(5); or
    (2) hunting deer without a license under IC 14-22-11-1 and 312 IAC 9-2-14.

    (c) The season for hunting deer under this SECTION of this document is as follows:
    (1) From October 1, 2011, through November 27, 2011, with a bow and arrow.
    (2) From November 12, 2011, through November 27, 2011, with firearms.
    (3) From December 3, 2011, through December 18, 2011, with muzzleloading guns.
    (4) From December 3, 2011, through January 1, 2012, with a bow and arrow or crossbows.

    (d) The seasonal limit for hunting under this SECTION of this document is one (1) antlerless deer for each deer license issued under this SECTION of this document.

    (e) An individual who hunts under this SECTION of this document may use bow and arrows, crossbow, or any firearms that may otherwise be lawfully used to take deer under 312 IAC 9-3.

    (f) 312 IAC 9-3-2(b) through 312 IAC 9-3-2(d) and 312 IAC 9-3-2(k) through 312 IAC 9-3-2(x) apply to a license issued under this SECTION of this document.

    (g) An individual must not exceed the county bag limit from each county as follows:
    (1) Adams - 2.

    A county bag limit of "A", as used in this subsection of this document, is one (1) antlerless deer. Notwithstanding subsection (d), a deer taken in a county with a bag limit of "A" must be taken only from November 24, 2011, through November 27, 2011, or from December 3, 2011, through January 1, 2012.

    (h) The extra deer bonus antlerless license authorized by this SECTION of this document do [sic, does] not apply to the following properties:
    (1) Atterbury Fish and Wildlife Area.
    (2) Blue Grass Fish and Wildlife Area.
    (3) Chinook Fish and Wildlife Area.
    (4) Crosley Fish and Wildlife Area.
    (5) Deer Creek Fish and Wildlife Area.
    (6) Francis Slocum State Forest.
    (7) Glendale Fish and Wildlife Area.
    (8) Goose Pond Fish and Wildlife Area.
    (9) Hillenbrand Fish and Wildlife Area.
    (10) Interlake State Recreation Area.
    (11) Kingsbury Fish and Wildlife Area.
    (12) LaSalle Fish and Wildlife Area.
    (13) Mississinewa Lake (including adjacent lands administered by the department of natural resources).
    (14) Patoka Lake, except east of State Road 145 (in Orange County and Crawford County) and south of State Road 164 (in Dubois County and Crawford County).
    (15) Pigeon River Fish and Wildlife Area.
    (16) Roush Lake Fish and Wildlife Area.
    (17) Salamonie Lake (including adjacent lands administered by the department of natural resources).
    (18) Salamonie River State Forest.
    (19) Splinter Ridge Fish and Wildlife Area.
    (20) Stucker Fork Fish and Wildlife Area.
    (21) Sugar Ridge Fish and Wildlife Area.
    (22) Tri-County Fish and Wildlife Area.
    (23) Wabashiki Fish and Wildlife Area.
    (24) Wilbur Wright Fish and Wildlife Area.
    (25) Winamac Fish and Wildlife Area.

    (i) The extra deer bonus antlerless license authorized by this SECTION of this document does not apply to the department properties listed in this subsection from November 12, 2011, through November 23, 2011:
    (1) Hovey Lake Fish and Wildlife Area.
    (2) Jasper-Pulaski Fish and Wildlife Area.
    (3) Kankakee Fish and Wildlife Area.
    (4) Minnehaha Fish and Wildlife Area.

    (j) The extra deer bonus antlerless license authorized by this SECTION of this document does not apply to the department properties listed in this subsection from November 12, 2011, through November 27, 2011:
    (1) Anspaugh Wetland Conservation Area.
    (2) Cedar Swamp Wetland Conservation Area.
    (3) Curtis Wetland Conservation Area.
    (4) Deniston Resource Area.
    (5) Durham Lake Wetland Conservation Area.
    (6) Eagle Lake Wetland Conservation Area.
    (7) Goose Lake Wetland Conservation Area.
    (8) Greene-Sullivan State Forest.
    (9) Jimmerson Wetland Conservation Area.
    (10) Mallard Roost Wetland Conservation Area.
    (11) Marsh Lake Wetland Conservation Area.
    (12) Mendenhall Wetland Conservation Area.
    (13) Rome City Wetland Conservation Area.
    (14) Ropchan Wetland Conservation Area.

    (k) The extra deer bonus antlerless license authorized by this SECTION of this document does not apply to Fairbanks Landing Fish and Wildlife Area from October 1, 2011, through November 23, 2011, and from December 3, 2011, through January 1, 2012.

    SECTION 7. (a) This SECTION supersedes 312 IAC 9-3-2(k).

    (b) An individual must, immediately upon taking a deer, record on a piece of paper the following:
    (1) The name and address of the individual who took the deer.
    (2) The license number (if applicable) of the individual who took the deer.
    (3) The sex of the deer.
    (4) The month and day the deer was taken.
    The individual that takes the deer must retain possession of the completed piece of paper until the paper is attached to the deer. The piece of paper must be attached to the deer if the individual who takes the deer does not maintain direct physical control of and constant visual contact with the deer carcass.

    SECTION 8. (a) This SECTION supersedes 312 IAC 9-3-3(f).

    (b) During the urban deer season established in 312 IAC 9-3-4(d), an individual must hunt deer only with bows and arrows described in 312 IAC 9-3-3(b)(1) through 312 IAC 9-3-3(b)(5). During the urban deer season established in 312 IAC 9-3-4(d), an individual must hunt deer only with bows and arrows, including crossbows, described in 312 IAC 9-3-3(b)(1) through 312 IAC 9-3-3(b)(7) during the late archery season described in section 312 IAC 9-3-4(c)(2).

    SECTION 9. SECTIONS 1 through 8 of this document expire on February 1, 2012.
