    Public Notice Regarding Changes in Statewide Methods and Standards for
    Setting Payments for Medicaid Enrolled Nursing Facilities

    In accordance with the public notice requirements of 42 CFR 447.205 and Section 1902(a)(13)(A) of the Social Security Act, the Indiana Family and Social Services Administration, Office of Medicaid Policy and Planning (OMPP) publishes this notice of proposed changes to the reimbursement methodology for nursing facilities.

    The OMPP proposes to modify the rate setting formula for nursing facilities (codified at 405 IAC 1-14.6) to specify certain additional costs as not allowable for reimbursement, to clarify the individuals considered as immediate family members, to modify the criteria for obtaining a related party exception, to clarify the definition of related parties for nonstate government owned (NSGO) nursing facilities, to revise the "grandfather date" for nursing facility special care unit (SCU) directors, to revise how cost report audits are implemented to comply with Section 126 of P.L. 229-2011, and to require nursing facility administrators to sign any requests for appeal under IC 4-21.5-3.

    These changes will be adopted as an emergency rule. A copy of this notice is now on file at the Indiana Government Center South, 402 West Washington Street, Room W451, Indianapolis, Indiana and open for public inspection. Also, a copy of this notice is now available and may be inspected by contacting the local county Division of Family Resources office, except in Marion County, where public inspection may be made at the Indiana Government Center South, 402 West Washington Street, Room W374, Indianapolis, Indiana.
