TITLE 240 STATE POLICE DEPARTMENT

Notice of Intent to Adopt a Rule

Under IC 4-22-2-23, the State Police Department intends to adopt a rule concerning the following:

OVERVIEW: This rulemaking action will amend 240 IAC 9-2-1 governing the definition of a "deadly weapon". It will allow for an exception to the deadly weapon classification of tasers, electronic stun weapons, and chemicals or other devices used to temporarily incapacitate a person for law enforcement officers who have been trained in their use and who use such devices in accordance with the law enforcement officer's training and while lawfully engaged in the execution of official duties. This amendment would bring the rule in compliance with IC 35-41-1-8. Statutory authority: IC 10-11-2-28.
