    DIGEST

    Temporarily amends 405 IAC 5-23-4 to revise the age of recipients subject to the covered eyeglasses limitation from under 19 to under 21 years of age and amends that limitation from one pair every two years to one pair every five years. Authority: IC 4-22-2-37.1(a)(19); IC 12-15-21-2; IC 12-15-21-3. Effective March 31, 2011.


    SECTION 1. (a) This SECTION supersedes 405 IAC 5-23-4(5).

    (b) Reimbursement for eyeglasses provided to a recipient under twenty-one (21) years of age will be limited to a maximum of one (1) pair per year only if the criteria set out in 405 IAC 5-23-4(7) have been met. The office will provide reimbursement for repairs or replacements of eyeglasses only after receiving documentation that the repair or replacement is necessary due to extenuating circumstances beyond the recipient's control, for example, fire, theft, or automobile accident. The documentation of the extenuating circumstances must be maintained in the provider's office and shall be subject to postpayment review and audit.

    SECTION 2. (a) This SECTION supersedes 405 IAC 5-23-4(6).

    (b) Reimbursement for eyeglasses provided to a recipient twenty-one (21) years of age or over is limited to a maximum of one (1) pair every five (5) years if the criteria set out in 405 IAC 5-23-4(7) have been met. Replacements will only be covered under 405 IAC 5-23-4(5).
