    Dear Senator Young:

    On behalf of the Office of the Secretary of Family and Social Services (Office), I am submitting this notice to the Administrative Rules Oversight Committee in compliance with IC 4-22-2-25, because the promulgation of the above-captioned rule may not be completed within one year after publication of the Notice of Intent to Adopt a Rule.

    The Office published its Notice of Intent to Adopt a Rule for the captioned document on August 15, 2012. The Proposed Rule, as well as the fiscal and economic analyses, have been prepared, but have not yet been sent to the State Budget Agency for preparation of that agency's fiscal and economic analyses of the Proposed Rule, as required under IC 4-22-2-28. The Proposed Rule must then be published in the Indiana Register, and the required public hearing can be held no earlier than 21 days after publication of the Proposed Rule.

    Following the public hearing, the agency must consider and respond to public comments and present the rule to the Secretary of the Family and Social Services for final adoption. Following the final rule adoption, the agency must compile a complete record of supporting documentation of the rulemaking process for submission to the Office of the Attorney General. Thereafter, the Office of the Attorney General has 45 days to complete a review of the rule and supporting documentation, after which the Governor has 30 days to complete his review. As a result of the foregoing matters, promulgation of this rule will likely not be completed by August 14, 2013.

    This notice setting forth the expected date of approval of LSA Document #12-488 as August 14, 2014, is being submitted in a timely manner. April 21, 2013, is the two hundred fiftieth day after publication of the Notice of Intent to Adopt a Rule.
