    Notice of Public Comment Period for Medicaid Home and Community-Based
    Services Programs Updated Statewide Transition Plan


    In accordance with public notice requirements of 42 CFR 441.301(c)(6)(B)(iii), the Indiana Family and Social Services Administration's (FSSA) Office of Medicaid Policy and Planning (OMPP) publishes this notice to advise changes to the Indiana Statewide Transition Plan.

    These changes are required pursuant to 42 CFR Part 430, 431 et al. Medicaid Program; State Plan Home and Community-Based Services, 5-Year Period for Waivers, Provider Payment Reassignment, and Home and Community-Based Setting Requirements for Community First Choice and Home and Community-Based Services (HCBS) Waivers. This regulation requires that all states that operate HCBS programs funded by the Centers for Medicare and Medicaid Services (CMS) ensure that individuals receiving these services are fully integrated in and have full access to the greater community. This includes opportunities to seek employment and work in competitive and integrated settings, engage in community life, control personal resources, and receive services in the community to the same degree as individuals who do not receive HCBS services. CMS requires all states to develop a transition plan providing detailed information on assessments, strategies, data, and timelines for coming into full compliance with the final rule.

    In December 2014, FSSA submitted the first Statewide Transition Plan to CMS. CMS has since notified the state that revisions to the Statewide Transition Plan are required and must be submitted to CMS for review by April 30, 2016.

    The programs Indiana currently operates under the HCBS authorities of 1915(c) and 1915(i) of the Social Security Act are as follows:

    • Community Integration and Habilitation 1915(c) HCBS Waiver
    • Aged and Disabled 1915(c) HCBS Waiver
    • Family Supports 1915(c) HCBS Waiver
    • Traumatic Brain Injury 1915(c) HCBS Waiver
    • Psychiatric Residential Treatment Facility 1915(c) HCBS Waiver
    • Adult Mental Health Habilitation 1915(i) HCBS State Plan benefit
    • Child Mental Health Wraparound 1915(i) HCBS State Plan benefit
    • Behavior and Primary Healthcare Coordination 1915(i) HCBS State Plan benefit

    FSSA is seeking public input on the updated Statewide Transition Plan. The HCBS Statewide Transition Plan will be posted for review on the FSSA HCBS Final Rule website at: www.in.gov/fssa/4917.htm. The Statewide Transition Plan will be open for 30 days for public comment from March 7, 2016 – April 6, 2016. This comment period will allow all HCBS members, providers, and stakeholders an opportunity to provide input on the plan.
