    EXECUTIVE ORDER: 08-04

    FOR: IMPLEMENTING INDIVIDUAL ASSISTANCE UNDER IC 10-14-4 IN EKLHART, KOSCIUSKO, AND MARSHALL COUNTIES AS A RESULT OF SEVERE STORMS AND TORNADOS ON OCTOBER 18, 2007.


    TO ALL TO WHOM THESE PRESENTS MAY COME, GREETINGS:

    WHEREAS, on October 18, 2007, Elkhart, Kosciusko and Marshall counties suffered severe storms and tornados; and

    WHEREAS, a state of disaster emergency was declared for Elkhart, Kosciusko and Marshall counties on November 1, 2007 by Executive Order 07-19;

    WHEREAS, more than 150 homes were extensively damaged or destroyed; and

    WHEREAS, hundreds of households have been displaced as a result of the violent weather; and

    WHEREAS, the United States Small Business Administration has issued an agency disaster declaration; and

    WHEREAS, not all of the households affected by the turbulent weather may be eligible for individual assistance under the United States Small Business Administration agency disaster declaration; and

    WHEREAS, in enacting Ind. Code 10-14-4-6, the Indiana General Assembly evidenced its intent that the state should make specific efforts to provide assistance to such ineligible families; and

    NOW, THEREFORE, I, Mitchell E. Daniels Jr., by virtue of the authority vested in me as Governor of the State of Indiana, do hereby

    DECLARE that individual assistance may be appropriate and necessary for households who suffered extensive damage or total destruction of some or all of their real and personal property and who are not otherwise eligible for assistance under the United States Small Business Administration agency disaster declaration, but are eligible under Ind. Code 10-14-4-6; and

    ORDER A. the Department of Homeland Security to:
    1. use the state disaster relief fund to make direct individual assistance grants as authorized under IC 10-14-4-6.
    2. create such forms and evaluation methods as necessary to ensure the appropriate use of the funds under IC 10-14-4-13.

    B. the Auditor's office, upon receipt of approved documentation from the Department of Homeland Security, to pay to each individual grantee the amount of the individual assistance grant.
