Notice of Public Hearing

Under IC 4-22-2-24, notice is hereby given that on April 12, 2016, at 9:30 a.m., at the Department of Insurance, 311 West Washington Street, Suite 103, Indianapolis, Indiana, the Department of Insurance will hold a public hearing on a proposed rule regarding certification and registration requirements, precertification education and examinations, continuing education, duties, conflicts of interest, privacy and security of information, reporting requirements, enforcement, and other matters relating to an individual acting as a navigator and an entity acting as an application organization in Indiana.

Navigators, application organizations, and precertification and continuing education course providers for navigators are new to Indiana as part of ACA and P.L.278-2013. P.L.278-2013 already requires many of the components of the proposed rule. It is the duty of the Department of Insurance to ensure that navigators and application organizations are complying with the requirements of P.L.278-2013, and more specific requirements and costs are necessary. The Department of Insurance has hired additional staff to oversee the certification of navigators, registration of application organizations, and the approval of precertification and continuing education providers for navigators. The fees associated with applications are intended to offset the fiscal impact to the Department of Insurance. The proposed rule contains a provision allowing a person to request a waiver of any fee imposed by the proposed rule upon a showing of good cause.
