TITLE 170 INDIANA UTILITY REGULATORY COMMISSION

DIGEST

Temporarily amends 170 IAC 1-6-5(a)(5) and 170 IAC 1-6-6 to exempt telecommunication carriers filing certain changes to intrastate access tariffs from complying with the notice requirements of 170 IAC 1-6. Statutory authority: IC 4-22-2-37.1(a)(7); IC 8-1-2-113. Effective March 10, 2011.

SECTION 1. (a) This SECTION is supplemental to 170 IAC 1-6.

(b) 170 IAC 1-6-5(a)(5) and 170 IAC 1-6-6 do not apply to intrastate access tariff changes that have the sole effect of:

(1) mirroring, adopting, or concurring in:

(A) rates;

(B) charges;

(C) terms;

(D) conditions; or

(E) a combination of clauses (A) through (D);

as set forth in an applicable interstate access tariff; or

(2) making corrections that are:

(A) clerical; or

(B) administrative;

to be determined at the sole discretion of the commission or its staff.
