Dear Representative Pelath:

On behalf of the Advisory Board of the Division of Professional Standards, I am submitting this notice regarding LSA [Document] #09-481 to the Administrative Rules Oversight Committee in compliance with IC 4-22-2-25. March 8, 2010, is the 250th day after publication of the Notice of Intent to Adopt a Rule for LSA [Document] #09-481. The final rule has been approved by the Board and the Attorney General is currently finishing his review.

This notice is submitted as a precautionary step in case the process is delayed with the Office of the Attorney General or with the Office of the Governor. We have no evidence that the process will be delayed; quite the opposite, both offices have been diligent. However, prudence dictates that this notice be filed as an administrative technicality and only because the 250th day is approaching. The Board expects that the rule will be approved by the Governor before June 30, 2010, and, should the minimal chance of delay occur, no later than August 31, 2010.

This notice setting forth the expected date of approval of LSA Document #09-481 as August 31, 2010, is being submitted in a timely manner.
