    PUBLIC COMMENTS UNDER IC 13-14-9-4.5
    IC 13-14-9-4.5 states that a board may not adopt a rule under IC 13-14-9 that is substantively different from the draft rule published under IC 13-14-9-4, until the board has conducted a third comment period that is at least 21 days long. Because this proposed rule is not substantively different from the draft rule published on October 15, 2014, at DIN: 20141015-IR-326120520SNA, the Indiana Department of Environmental Management (IDEM) is not requesting additional comment on this proposed rule.

    SUMMARY/RESPONSE TO COMMENTS FROM THE SECOND COMMENT PERIOD
    The Indiana Department of Environmental Management (IDEM) requested public comment from October 15, 2014, through November 14, 2014, on IDEM's draft rule language.
    IDEM received comments from the following parties:
    ERM, on behalf of Allison Transmission (Allison)
    Carmeuse Lime & Stone (Carmeuse)
    Following is a summary of the comments received and IDEM's responses thereto:
    Comment: 326 IAC 6.5-6-2 establishes particulate matter emission limits for Boilers 1, 2, 3, 4 and 5 at the Allison Transmission facility, Source ID 097-00310. Boilers 1, 2 and 3 have been removed from the facility. The reference to these three boilers should be removed from this regulation. Additionally, the Source ID for Allison Transmission is listed as 00017, which was the Source ID when Allison Transmission was under previous ownership. The correct Source ID is 00310. (Allison)
    Response: IDEM will include amendments to 326 IAC 6.5-6-2 in the draft rule for preliminary adoption and has modified the rule as suggested.
    Comment: Carmeuse has requested changes to the emission limitations for the following control devices: ALG 450, 460, 600, 320, 400, 310, and 300 and AKG 141 and 450. In the Second Notice of Comment Period, IDEM indicated that it was continuing to work with Carmeuse to develop air quality monitoring that would support the requested SIP revision. Carmeuse has proposed modifying certain stacks from a horizontal to a vertical orientation. With these changes, IDEM has indicated that the requested emission limitation changes would not cause or contribute to violations of either the PM10 or PM2.5 National Ambient Air Quality Standards. As all the modeling issues have been addressed, the commenter requests that the requested changes be included in the current rulemaking. (Carmeuse)
    Response: IDEM will need to share the modeling results with the United States Environmental Protection Agency to obtain their agreement that the amendments will be appropriate for approval as part of the Indiana State Implementation Plan (SIP). There will not be enough time to do this before preliminary adoption of this rulemaking and IDEM will start another rulemaking to make these amendments for Carmeuse.

    (B) available for an additional two (2) years.

    (A) When using only #4 fuel oil, the amount used for the listed boilers collectively is not to exceed thirty-seven million one hundred forty-two thousand eight hundred (37,142,800) gallons per year based on a three hundred sixty-five (365) day rolling figure.
    (B) When using coal, #4 fuel oil, #6 fuel oil, #2 fuel oil, natural gas, or landfill gas, the limitation listed in clause (A) shall be adjusted as follows:
    (i) When using #6 fuel oil, the gallons per year of #4 fuel oil shall be reduced by two and six-tenths (2.6) gallons per gallon used.
    (ii) When using natural gas, the gallons per year of #4 fuel oil shall be reduced by eighty-eight hundred-thousandths (0.00088) gallon per cubic foot of natural gas burned.
    (iii) When using #2 fuel oil, the gallons per year of #4 fuel oil shall be reduced by twenty-eight hundredths (0.28) gallon per gallon used.
    (iv) When using landfill gas, the gallons per year of #4 fuel oil shall be reduced by one hundred sixteen hundred-thousandths (0.00116) gallon per cubic foot of landfill gas burned.
    (4) (3) Maintain a log to document compliance with subdivision (3), (2). These records shall be:
    (A) maintained for at least the previous twenty-four (24) month period; and
    (B) made available upon request by the department.

    (3) Compliance with the combined lb/hr emission limitation shall be on a daily basis. Compliance shall be demonstrated by a calculation of the sum of the total pounds of PM10 emitted on each calendar day from all dryers that operated in that calendar day, divided by twenty-four (24) hours.
