    DIGEST

    Amends 804 IAC 1.1-2-5, 804 IAC 1.1-6-3, 804 IAC 1.1-7-1, 804 IAC 1.1-7-2, and 804 IAC 1.1-7-7 concerning the issuance of a certificate of registration, admission to examinations, scope of rule, the definition of intern, and completion of training and experience. Effective 30 days after filing with the Publisher.



    SECTION 1. 804 IAC 1.1-2-5 IS AMENDED TO READ AS FOLLOWS:

    804 IAC 1.1-2-5 Issuance of certificate of registration

    Sec. 5. (a) Upon successful completion of the examination or reciprocity process, requirements for registration and the board's approval of the application, the board shall:
    (1) order a certificate of registration to be issued to the applicant; and
    (2) designate the date of the certificate.
    Upon receipt of the registration fee, the board will assign a certificate number to the registrant. Thereafter, the board will issue a registration card and provide a certificate of registration.

    (b) If the board does not approve the application, the applicant shall be notified in writing of the grounds for its action. Notification shall be mailed to the last address furnished by the applicant.

    (c) Failure of the any applicant to pay the registration issuance fee will cause the application to be terminated one (1) year after the board's action granting registration provided the board shall have sent a second notice to the applicant.

    (d) The original registration fee for the reciprocal license must be paid by the applicant within sixty (60) days of approval thereof by the board or the license shall not be issued.

    (e) The secretary is authorized to order for engrossment a duplicate or replacement certificate of registration. Such new certificate of registration shall be assigned the original certificate number with the word "duplicate" inserted above the number and shall be signed by the qualified board members and secretary. A fee shall be paid before engrossment of the certificate.

    (d) Each registrant shall keep the board advised of his or her current address.

    SECTION 2. 804 IAC 1.1-6-3 IS AMENDED TO READ AS FOLLOWS:

    804 IAC 1.1-6-3 Admission to examinations

    Sec. 3. (a) The board will admit an applicant for registration as a landscape architect to an examination only if the applicant otherwise qualifies for the registration for which application has been made, including the meeting of the applicable education and experience requirements.

    (b) The board will admit an applicant for registration as an architect to an examination only if the applicant submits evidence to the board that the person has:
    (1) graduated with a professional degree from a school or college of architecture accredited by the National Architectural Accrediting Board, Inc., or its successor; and
    (2) not been convicted of:
    (A) an act that would constitute a ground for disciplinary sanction under IC 25-1-11; or
    (B) a felony that has direct bearing on the applicant's ability to practice competently.

    SECTION 3. 804 IAC 1.1-7-1 IS AMENDED TO READ AS FOLLOWS:

    804 IAC 1.1-7-1 Scope of rule

    Authority: IC 25-4-1-3


    Sec. 1. (a) This rule implements IC 25-4-1-7(a)(2) IC 25-4-1-6 and IC 25-4-1-7.5 by establishing the training and experience requirements for admission to the examination for registration as an architect.

    (b) This rule applies to admission to examinations conducted after May 1991.

    (c) Individuals who:
    (1) were admitted to an examination conducted before June 1991; and
    (2) failed to pass that examination;
    shall not be required to comply with the requirements of this rule in order to retake the examination after May 1991.

    (d) Out-of-state architects applying for registration under IC 25-4-1-8(c)(2)(A)(i) must meet the requirements of this rule if they would have had to meet them under the provisions of subsections (b) and (c) if they had been initially registered in Indiana.

    (e) Out-of-state architects applying for registration under IC 25-4-1-8(c)(2)(A)(i) who have practiced architecture for five (5) years after registration in another state do not need to comply with subsection (d).

    SECTION 4. 804 IAC 1.1-7-2 IS AMENDED TO READ AS FOLLOWS:

    Sec. 2. As used in this rule, "intern" means an individual obtaining the training and experience required by IC 25-4-1-7(a)(2) IC 25-4-1-7.5 and this rule.

    Sec. 7. (a) Regardless of the acquisition of value units under this rule, the required training and experience may not be completed in a period of less than three (3) years.

    (b) The required training and experience shall be completed no less than ninety (90) days prior to the applicable examination date.
