IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses

1. Description of the Rule

The rule amends 345 IAC 1-5-1 and adds 345 IAC 1-5-1.5 to clarify that the requirement to vaccinate dogs, cats, and ferrets for rabies is met when a vaccination is administered by a registered veterinary technician or veterinary assistant working under the direct supervision of a veterinarian. Amends 345 IAC 1-5-3 to update the Compendium on Animal Rabies Control incorporated by reference.

2. Description of Affected Industry

The Indiana Board of Veterinary Medical Examiners (IBVME) licenses veterinarians and registers veterinary technicians under IC 25-38.1. There are currently 1,365 Indiana licensed veterinarians.

3. Reporting, Record Keeping, and Other Administrative Costs

The proposed changes to the Indiana State Board of Animal Health (BOAH) rabies rule will not require additional reporting, record keeping, or other administrative costs on anyone.

4. Estimated Total Annual Economic Impact on Small Businesses

The BOAH does not anticipate increased costs to small businesses as a result of adopting the rule.

5. Justification for Costs

The rule will make clear that veterinarians may utilize registered veterinary technicians and veterinary assistants to administer rabies vaccinations as long as the veterinarian maintains direct supervision over the technicians and assistants. This change will allow veterinarians more flexibility in how animals in their clinic are treated. The proposed rule change will not impose increased costs on businesses.

6. Regulatory Flexibility Analysis

The purpose of the rule is to clarify required procedures for rabies vaccinations and to permit additional flexibility in how animals are vaccinated for rabies while maintaining veterinary responsibility for the procedure. The BOAH chose a procedure that is more flexible for veterinarians over the option of not changing current rules because the current rule was becoming increasingly at odds with the common and usual practices utilized in the veterinary profession.
