    DIGEST

    Temporarily amends 312 IAC 9 to establish a season in February 2009 for taking Canada geese (Branta canadensis) in 30 Indiana counties and to establish a season in spring 2009 for taking lesser snow geese and Ross's geese in support of a federal effort to control the numbers of these geese. Effective February 1, 2009.


    SECTION 1. (a) This SECTION is supplemental to 312 IAC 9-4.

    (b) A person may take a Canada goose (Branta canadensis) under this SECTION of this document from February 1 through February 15, 2009.

    (c) A person must obtain a free permit from the department to take a Canada goose under this SECTION.

    (d) In order to take a Canada goose under this SECTION, a person must satisfy all of the following requirements:
    (1) Possess one (1) of the following valid Indiana hunting licenses:
    (A) resident yearly hunting license pursuant to IC 14-22-12-1(a)(2);
    (B) resident yearly hunting and fishing license pursuant to IC 14-22-12-1(a)(3);
    (C) nonresident yearly hunting license pursuant to IC 14-22-12-1(a)(6);
    (D) nonresident five-day hunting license pursuant to IC 14-22-12-1(a)(10);
    (E) resident youth consolidated hunting license pursuant to IC 14-22-12-1(a)(24) or IC 14-22-11-10(b);
    (F) disabled American veteran's hunting license pursuant to IC 14-22-12-1.5;
    (G) an apprentice hunting license pursuant to IC 14-22-12-1.7;
    (H) lifetime basic hunting license pursuant to IC 14-22-12-7(a)(2);
    (I) lifetime comprehensive hunting license pursuant to IC 14-22-12-7(a)(4);
    (J) lifetime comprehensive hunting and fishing license pursuant to IC 14-22-12-7(a)(5);
    or be exempt from needing a license as authorized in IC 14-22-11-1.
    (2) Possess a valid Indiana waterfowl stamp privilege issued under IC 14-22-7-4.
    (3) Possess a valid Harvest Information Program registration number issued under 312 IAC 9-4-2.
    (4) Possess a valid and signed federal migratory bird hunting and conservation stamp under 16 U.S.C. 718a.

    (e) A person must comply with all requirements for hunting waterfowl in 50 CFR 20, IC 14-22-6, and 312 IAC 9.

    (f) A person may take a Canada goose in the following counties only:
    (1) Adams.
    (2) Allen.
    (3) Boone.
    (4) Clay.
    (5) Dekalb.
    (6) Elkhart.
    (7) Greene.
    (8) Hamilton.
    (9) Hancock.
    (10) Hendricks.
    (11) Huntington.
    (12) Johnson.
    (13) Kosciusko.
    (14) LaGrange.
    (15) LaPorte.
    (16) Madison.
    (17) Marion.
    (18) Marshall.
    (19) Morgan.
    (20) Noble.
    (21) Parke.
    (22) Shelby.
    (23) Starke.
    (24) Steuben.
    (25) St. Joseph.
    (26) Sullivan.
    (27) Vermillion.
    (28) Vigo.
    (29) Wells.
    (30) Whitley.

    (g) A person may take no more than five (5) Canada geese per day. The possession limit is ten (10) Canada geese.

    (h) A person who takes a Canada goose under this SECTION must cause delivery of the goose to an official goose checking station within forty-eight (48) hours of taking the goose or by 3:00 p.m. local time on February 15, 2009, whichever is sooner.

    SECTION 2. SECTION 1 of this document expires February 16, 2009.

    SECTION 3. (a) This SECTION of this document is supplemental to 312 IAC 9-4.

    (b) A person may take a lesser snow goose (Anser caerulescens) or a Ross's goose (Anser rossii) under this SECTION of this document from February 16, 2009, through March 31, 2009.

    (c) In order to hunt a lesser snow goose or a Ross's goose under this SECTION, a person must satisfy all of the following requirements:
    (1) Possess one (1) of the following valid Indiana hunting licenses:
    (A) resident yearly hunting license pursuant to IC 14-22-12-1(a)(2);
    (B) resident yearly hunting and fishing license pursuant to IC 14-22-12-1(a)(3);
    (C) nonresident yearly hunting license pursuant to IC 14-22-12-1(a)(6);
    (D) nonresident five-day hunting license pursuant to IC 14-22-12-1(a)(10);
    (E) resident youth consolidated hunting license pursuant to IC 14-22-12-1(a)(24) or IC 14-22-11-10(b);
    (F) disabled American veteran's hunting license pursuant to IC 14-22-12-1.5;
    (G) an apprentice hunting license pursuant to IC 14-22-12-1.7;
    (H) lifetime basic hunting license pursuant to IC 14-22-12-7(a)(2);
    (I) lifetime comprehensive hunting license pursuant to IC 14-22-12-7(a)(4);
    (J) lifetime comprehensive hunting and fishing license pursuant to IC 14-22-12-7(a)(5);
    or be exempt from needing a license as authorized in IC 14-22-11-1.
    (2) Possess a valid Indiana waterfowl stamp privilege issued under IC 14-22-7-4.

    (d) In addition to the requirements in subsection (c), a person must obtain a free permit from the department to take a lesser snow goose or Ross's goose under this SECTION.

    (e) Notwithstanding 312 IAC 9-4-2, a person taking a lesser snow goose or Ross's goose under this SECTION is exempted from the requirements to register for and possess an identification number through the Harvest Information Program.

    SECTION 4. SECTION 3 of this document expires on April 1, 2009.
