    Under IC 4-22-2-24, notice is hereby given that on December 17, 2010, at 12:30 p.m., at the Indiana Government Center South, 302 West Washington Street, Conference Center Room 14, Indianapolis, Indiana, the Fire Prevention and Building Safety Commission will hold a public hearing on a proposed rule to amend 675 IAC 12-6-9 to update and clarify, add 675 IAC 14-4.3-256.5 to add Chapter 42, Swimming Pools, to the 2005 Indiana Residential Code, amend 675 IAC 20-1.1 to create the Indiana Swimming Pool, Spa and Water Attraction Code, third edition, and amend definitions, amend and update 675 IAC 20-2, amend 675 IAC 20-4-1, add 675 IAC 20-5, Water Attractions, and repeal 675 IAC 20-4-2 through 675 IAC 20-4-27.
    The Fire Prevention and Building Safety Commission has authority to adopt this rule under IC 22-13-2. This rule updates the Indiana Swimming Pool Code, which was adopted in 1992, and adds the regulation of the fast-growing sector of water attractions. The amendments to the Swimming Pool Code include numerous new definitions to reflect changes in the water entertainment field in the last 18 years and provide for greater health and safety protection of users. In addition, the rule moves the regulations affecting swimming pools and spas at one and two family dwellings and townhouses to the Indiana Residential Code. The increased cost associated with the Virginia Graeme Baker Pool and Spa Safety Act, approximately $5,000 per pool and spa, is required of all states, and is a result of fatality in a swimming pool without this protection. The number of water attractions has increased significantly in the last 10 years, according to the stakeholders present at the meetings of the Swimming Pool Code Review Committee, and these present both health and safety hazards that are not now regulated for the protection of Indiana residents, including young children. One of the primary hazards is the spread of infection. The cost of the UV treatment equipment to prevent the spread of Cryptosporidium was estimated at $5,800 for up to several water attractions. The prevention of the spread of this parasite is a current public safety concern. The Commission relied on data provided by the members of the Swimming Pool Code Review Committee to determine the costs associated with this rule.
