Dear Senator Young:

On behalf of the Indiana Department of Insurance (Department), I am submitting this notice to the Administrative Rules Oversight Committee in compliance with IC 4-22-2-19, which requires an agency to begin the rulemaking process not later than sixty (60) days after the effective date of the statute that authorizes the rule.

P.L.131-2007, which authorizes the rule, became effective on January 1, 2008. Due to an oversight, the Department did not publish a Notice of Intent until March 5, 2008, which is sixty-four (64) days after the January 1 effective date. The Department expects to publish a proposed rule by December 31, 2008, and expects to hold a public hearing by February 13, 2009. In order to provide ample time to review comments received at the public hearing and for the appropriate review times, the Department expects to have the final rule approved by May 29, 2009.
