    EXECUTIVE ORDER: 13-22

    FOR: STRUCTURING THE INDIANA INTELLIGENCE FUSION CENTER


    TO ALL WHOM THESE PRESENTS MAY COME, GREETINGS.

    WHEREAS, the timely exchange of intelligence and critical law enforcement information among local, state and federal agencies remains one of the most serious challenges affecting homeland security;

    WHEREAS, in 2006, Governor Daniels created the Indiana Intelligence Fusion Center (Fusion Center) through Executive Order 06-04 to enhance the process of analyzing information by creating a structure that local, state and federal agencies can use to share information and combine their efforts more effectively;

    WHEREAS, the Indiana General Assembly established the Fusion Center under Ind. Code § 10-11-9 "to collect; integrate; evaluate; analyze; disseminate; and maintain criminal intelligence information to support governmental agencies and private organizations in detecting, preventing, investigating and responding to criminal and terrorist activity in compliance with applicable state and federal law;"

    WHEREAS, the Fusion Center locates representatives of local, state, and federal agencies and private organizations in the same facility to share information and to facilitate joint efforts to prevent and solve crimes and to better protect the public;

    WHEREAS, the future of the Fusion Center is to build upon the current structure adding depth and reach in an effort to reduce duplicative governmental functions and strengthen capacity and to serve as the "all crimes-all hazards" approach to all encompassing public safety and homeland security;

    WHEREAS, the ongoing operations, continued development and strengthening of the Fusion Center will continue to enable our federal law enforcement, intelligence and other critical mission partners at the national level to distribute criminal information and intelligence to one place in Indiana with the certain knowledge that it will be promptly disseminated to those agencies located in Indiana who need the information to better protect the public; and

    WHEREAS, consistent with national best practice trends for information sharing, collaboration and coordination of multilevel government organizations with common goals for the safety and wellbeing of the citizens of Indiana and in the interest of national homeland security priorities, the Fusion Center will continue to operate in accordance with Ind. Code § 10-11-9-3 and at the direction of the Governor.

    NOW, THEREFORE, I, Michael R. Pence, by virtue of the authority vested in me as Governor of the State of Indiana, do hereby order that:

    1. Executive Order 06-04 is rescinded.

    2. In addition to the duties outlined in Ind. Code § 10-11-9-3, the Fusion Center will consider new areas of intelligence information, such as "all crimes-all hazards" information, including: first responders, public health, critical infrastructure and key resources sectors, and cybersecurity.

    3. The Executive Committee for the Fusion Center shall continue and have the responsibility for the governance, strategic planning and oversight of the Fusion Center.

    4. The Executive Committee shall be chaired by the Executive Director of Indiana Department of Homeland Security.

    5. The Executive Committee shall be comprised of the following twenty-two (22) members or their designees, each of whom shall by appointed by, and serve without compensation at the pleasure of the Governor:
    a. U.S. Attorney for the Southern District of Indiana
    b. U.S. Attorney for the Northern District of Indiana
    c. Special Agent in Charge of the Indianapolis Field Office of the Federal Bureau of Investigation
    d. Director of the Indiana Department of Homeland Security
    e. Adjutant General of Indiana
    f. Superintendent of the Indiana State Police
    g. Superintendent of the Indiana Excise Police
    h. Director of Law Enforcement for the Indiana Department of Natural Resources
    i. Marion County Sheriff
    j. Chief of the Indianapolis Metropolitan Police Department
    k. Executive Director of the Indiana Sheriffs Association
    l. Executive Director of the Indiana Association of Chiefs of Police
    m. Executive Director of the Indiana Gaming Commission
    n. Commissioner of the Indiana Department of Corrections [sic]
    o. President of the Indiana Campus Law Enforcement Administrators
    p. Representative of the U.S. Department of Homeland Security Transportation Security Administration
    q. Representative of the U.S. Department of Homeland Security Office of Intelligence and Analysis
    r. Commissioner of the Indiana Bureau of Motor Vehicles
    s. State Health Commissioner
    t. Chief Information Officer, Indiana Office of Technology
    u. Chairman of the Indiana Utility Regulatory Commission
    v. Executive Director of the Public [sic] Licensing Agency

    6. The Chair of the Executive Committee may create one or more advisory group or subcommittee of the Executive Committee as necessary.

    7. The Executive Committee shall approve the selection of an Executive Director for the Fusion Center, who shall be an officer of a state law enforcement agency with experience in information gathering and analysis, and who shall serve at the pleasure of the Executive Committee.

    8. The Executive Committee or an advisory or subcommittee group of the Executive Committee shall refine and update the current Charter to include new and emerging trends, needs, research and analysis. The Executive Committee or an advisory or subcommittee group of the Executive Committee also shall develop a sustainability plan and two year strategic plan to be required for each budget cycle consistent with the Office of Management and Budget guidance for performance metrics and budget analysis. The Charter and the strategic plan shall be updated every two years in order to ensure it is consistent with current local, state and national trends, needs and resources.

    9. The Fusion Center shall gather, collect, maintain and disseminate information as allowable based on the classification level, audience and subject matter to which it pertains under the relevant applicable federal and state laws.

    10. The Executive Committee shall meet at a minimum quarterly and as called by the Chair as the Chair deems necessary.

    11. The Executive Committee may add new members, with the approval of the Governor, if it determines new members are necessary based on emerging trends related to the work of the Fusion Center. A majority vote of the Executive Committee will determine if new members will be added to the Executive Committee.

    12. The Executive Committee shall develop and publish an Indiana Intelligence Fusion Center Privacy Policy in consultation with the appropriate legal experts. The policy must require the Fusion Center to operate within the limits of federal and state public access and privacy laws. An effective policy will enable the Fusion Center and its members to preserve the integrity and effectiveness of their public safety responsibility and law enforcement functions while also protecting our citizens from the inappropriate use or release of personal information. The Privacy Policy must be updated at least every two years and must be current with privacy laws and regulations.
