    Under IC 4-22-2-24, notice is hereby given that on December 14, 2009, at 10:05 a.m., at the Indiana Professional Licensing Agency, Indiana Government Center South, 402 West Washington Street, Room W064, Indianapolis, Indiana, the Behavioral Health and Human Services Licensing Board will hold a public hearing on proposed amendments to 839 IAC 1-2-5 to implement rule changes based on P.L.134-2008 (HEA 1172) and P.L.122-2009 (SEA 96) to establish fees for the newly created marriage and family therapist associates, addiction counselors, and clinical addiction counselors license types.
    The Behavioral Health and Human Services Licensing Board has the authority to promulgate rules in accordance with IC 25-23.6-8-1.5(6), IC 25-23.6-8-8.5(b)(1), IC 25-23.6-10.5-1(5), IC 25-23.6-10.5-2(5), and IC 25-23.6-10.5-12(b), to establish fees under IC 25-1-8-2 in order to implement changes in accordance with the requirements of P.L.134-2008 (HEA 1172) and P.L.122-2009 (SEA 96) allowing for the establishment of application and renewal fees for marriage and family therapist associates, addiction counselors, and clinical addiction counselors. The proposed renewal and application fee rule for marriage and family therapist associates, addiction counselors, and clinical addiction counselors will not have an estimated economic impact of greater than $500,000 on regulated persons. The proposed rule will have an insignificant fiscal impact on state or local government. The proposed renewal and application fee rule for marriage and family therapist associates, addiction counselors, and clinical addiction counselors will impose costs on the small businesses affected by this proposed rule. However, the fiscal impact of this proposed rule is dependent on the number of applicants that seek licensure, which might vary.
    Copies of these rules are now on file at the Indiana Government Center South, 402 West Washington Street, Room W072 and Legislative Services Agency, One North Capitol, Suite 325, Indianapolis, Indiana and are open for public inspection.
