    Rule 1. Health Care Volunteer Registry


    810 IAC 2-1-1 Scope

    Authority: IC 25-22.5-15-5

    Sec. 1. This rule establishes the process to implement a health care volunteer registry, including the process for registration, renewal, and removal of certain persons licensed to provide health care services who intend to provide voluntary health care services.

    810 IAC 2-1-2 Definitions

    Authority: IC 25-22.5-15-5

    Sec. 2. (a) The definitions in this section apply throughout this rule.

    (b) "Agency" refers to the Indiana professional licensing agency established by IC 25-1-5-3.

    (c) "Registry" refers to the electronic health care volunteer registry established by IC 25-22.5-15-1.

    810 IAC 2-1-3 Maintenance of the registry

    Sec. 3. (a) The registry shall be made available to the public on the Internet through the computer gateway administered by the office of technology established by IC 4-13.1-2-1, including each registrant's:
    (1) name;
    (2) city and state of residence;
    (3) licensed profession;
    (4) license number;
    (5) date of registration; and
    (6) date of expiration for the registration.

    (b) Upon request, the agency shall have access to and copies of all documents listed in IC 34-30-13-1.2 that a practitioner used to establish immunity from civil liability in treating an individual.

    810 IAC 2-1-4 Registration of licensed persons on the registry

    Authority: IC 25-22.5-15-5

    Sec. 4. (a) The registration to be completed by an approved person licensed to provide health care services for inclusion on the registry shall be made upon an electronic form published online by the agency.

    (b) All information in the registration shall be submitted under oath or affirmation, subject to the penalties of perjury.

    (c) The registration form submitted to the agency shall be complete.

    810 IAC 2-1-5 Expiration; renewal

    Sec. 5. (a) A registration of a licensed person under section 4 of this rule is valid for no more than two (2) years.

    (b) An approved person on the registry shall renew their registration for the registry in conjunction with their profession's renewal application.

    (c) The agency shall include an option on application and renewal forms for professions listed under IC 34-30-13-1.2(a)(1) for applicants to register for the registry and for approved persons to renew their registrations for the registry.

    810 IAC 2-1-6 Removal of individuals from registry

    Authority: IC 25-22.5-15-5

    Sec. 6. (a) The agency may remove a licensed person or any other registrant from the registry if:
    (1) the registrant fails to comply with any of the requirements listed in IC 34-30-13, specifically including, but not limited to:
    (A) any conditions required for immunity from civil liability; or
    (B) maintaining a license on active status for a profession listed in IC 34-30-13-1.2;
    (2) the office of the attorney general submits a written request to the agency to remove the registrant from the registry because the person poses a risk to the health, safety, or welfare of the public.

    (b) The agency shall take reasonable actions necessary to verify subsection (a)(1) or (a)(2).

    (c) The agency shall notify the person of their removal from the registry.
