Notice of Public Hearing

Under IC 4-22-2-24, notice is hereby given that on November 21, 2013, at 10:00 a.m., at the State of Indiana Forensic and Health Sciences Laboratories, 550 West 16th Street, Room N114, Indianapolis, Indiana, the State Department of Toxicology will hold a public hearing on a proposed rule to establish standards and regulations for breath test operators and breath test equipment.

The proposed rule requires breath test operators to complete training, to be recertified by examination every two years, and to follow approved methods in the administration of evidentiary breath tests on instruments purchased and maintained by ISDT. ISDT is charged under IC 9-30-6-5 to adopt rules concerning standards and regulations for breath test operators and breath test equipment, and the proposed rule complies with the statute.

Copies of these rules are on file at the State Department of Toxicology, 550 West 16th Street and Legislative Services Agency, Indiana Government Center North, 100 North Senate Avenue, Room N201, Indianapolis, Indiana and are open for public inspection.
