Dear Representative Murphy,

On behalf of the Emergency Medical Services Commission (Commission), I am submitting this notice to the Administrative Rules Oversight Committee in compliance with IC 4-22-2-25 because the EMS Commission has determined that the promulgation of the captioned rule will not be completed within one year after publication of the notice of intent to adopt a rule.

The Commission published its notice of intent to adopt a rule for the captioned document on February 1, 2006 (29 IR 1584). The authority for the rule adoption is IC 16-31-2-7; IC 16-31-3-14; IC 16-31-3-14.5; IC 16-31-3-20. The promulgation of this rule has taken longer than anticipated. The EMS Commission is working with the regulated community to ascertain the fiscal impact on small business imposed by the proposed amendments. The Commission expects that the rule can be approved by the Governor by July 31, 2007.

This notice setting forth the expected date of approval of LSA Doc. #06-11 as July 31, 2007, is being submitted in a timely manner. October 8, 2006, is the two hundred and fiftieth day after publication of the notice of intent to adopt a rule.
