    Notice of Intent to Adopt a Rule

    Under IC 4-22-2-23, the Division of Aging intends to adopt a rule concerning the following:

    OVERVIEW: Adds 455 IAC 1-1 for nursing home prescreening. It is identical to, and will replace, the current rules at 460 IAC 1-1 except for the following amendments to the present rules. The new rules will include contractors in the definition of "office"; replace references to "DDARS", the Division of Disability, Aging, and Rehabilitative Services, the "bureau", and the Bureau of Aging and In-Home Services with references to the Division of Aging; incorporate a new long-term care screening and options counseling program into the PAS process; expand the opportunities to request whether home-based services are available and appropriate; modify the responsibilities of the prescreening agency and PAS team; and establish intermediate nursing facility level of care as the minimum level of care standard necessary to be determined appropriate for admission to a nursing facility. It will also add a new section to establish a long-term care screening and options counseling program. Statutory authority: IC 12-8-8-4; IC 12-9.1-2-3.
