    EXECUTIVE ORDER: 09-11

    FOR: NAMING SEVEN INDIANA MEMBERS TO THE KENTUCKY/ INDIANA BI-STATE AUTHORITY


    TO ALL TO WHOM THESE PRESENTS MAY COME, GREETINGS:

    WHEREAS, the Louisville Southern Indiana Ohio River Bridges Project is critical to the cross river mobility, general transportation, safety and economic development needs of the State of Indiana and the Commonwealth of Kentucky; and

    WHEREAS, the State of Indiana and the Commonwealth of Kentucky have worked cooperatively on the Project for several years; and

    WHEREAS, the Federal Highway Administration issued a Record of Decision approving the Final Environmental Impact Statement for the Project on September 6, 2003; and

    WHEREAS, the State of Indiana and the Commonwealth of Kentucky have continued design work as well as right of way acquisition for parts of the Project since issuance of the ROD; and

    WHEREAS, in the interest of accelerating development and construction of the Project, the Kentucky General Assembly during the 2009 Extraordinary Session enacted Sections 75 through 98 of House Bill 3, which among other provisions establishes the framework for a Bi-State Authority, inviting the State of Indiana to participate with the Commonwealth of Kentucky as members of the Bi-State Authority, consistent with the laws of both states, in the further development, design, construction, operation, financing and oversight of the Project;

    WHEREAS, the Commonwealth of Kentucky and the City of Louisville in accordance with the abovementioned Kentucky statute have appointed seven (7) Kentucky members to the Bi-State Authority; and

    WHEREAS, it is in the best interest of the State of Indiana for the efficient and cooperative furtherance of the Project that Indiana have seven (7) Indiana members on the Bi-state Authority.

    NOW, THEREFORE, I, Mitchell E. Daniels, Jr., by virtue of the authority vested in me as Governor of the State of Indiana, do hereby order that:

    1. The Governor shall appoint seven individuals with extensive background in business, finance, community development or law as Indiana's representatives to the Bi-State Authority for a term of two (2) years, to serve at the pleasure of the Governor, to cooperate with representatives of the Commonwealth of Kentucky and within the limitations of the laws of each state, to develop, finance and construct the Louisville Southern Indiana Ohio River Bridges Project.

    2. The Indiana representatives appointed to the Bi-State Authority are not a commission, committee or any other body, but are individuals and may vote on the Bi-State Authority as individuals, in the best interests of the State of Indiana.

    3. The Indiana Department of Transportation is to provide staff and technical support to Indiana members in the discharge of their duties on the Bi-State Authority, and all other agencies and departments of the State of Indiana shall cooperate with and provide assistance as needed in implementing this Executive Order to the fullest extent permitted by law.

    4. All Indiana members shall serve without salary or per diem, except that members shall be reimbursed in accordance with state law and the policies of the Department of Administration and the State Budget Agency for actual expenses incurred in carrying out their responsibilities on the Bi-State Authority.

    5. INDOT, as staff to the Indiana members, shall provide periodic reports to the Governor and the General Assembly, as requested or necessary, on the activities of the Bi-State Authority.
