Notice of Public Hearing

Under IC 4-22-2-24, notice is hereby given that on January 21, 2016, at 9:40 a.m., at the Indiana State Board of Animal Health, 1202 East 38th Street, Discovery Hall Suite 100, Indianapolis, Indiana, the Indiana State Board of Animal Health will hold a public hearing on a proposed rule that amends 345 IAC 1-2.1 governing garbage feeding and disposal. The proposed rule conforms the Indiana State Board of Animal Health's rules to the United States Department of Agriculture - Animal and Plant Health Inspection Service (USDA-APHIS) requirements at 9 CFR 166 governing swine health protection. The proposed rule aligns certain definitions with the federal swine health regulations, establishes a licensing and inspection process for a person desiring to operate a facility to produce treated garbage, and incorporates the federal garbage handling and treatment regulations by reference.

The proposed rule does not impose costs beyond what is expressly required by state and federal law. Therefore, the proposed rule does not impose costs on a regulated entity that would require a justification statement under IC 4-22-2-24(d)(3).

Copies of these rules are now on file at the Indiana State Board of Animal Health, 1202 East 38th Street, Discovery Hall Suite 100 and Legislative Services Agency, Indiana Government Center North, 100 North Senate Avenue, Room N201, Indianapolis, Indiana and are open for public inspection.
