Section 910IAC1-3-4. Consent agreements

  •    The director or such person as the director designates may sign a consent agreement with regard to settlement in any case. Such agreement, however, is not final unless approved by the commission. A consent agreement approved by the commission shall be binding on the commission and shall be enforceable as a final order by the commission against any party signing such agreement. The commission may enforce such agreement by action brought in a circuit or superior court upon a showing that such party:

    (1) has failed to comply with one (1) or more terms or conditions of the consent agreement;

    (2) is subject to the commission's jurisdiction; and

    (3) resides or transacts business within the county in which the petition for enforcement is brought.
